Consumers

Article 1. General

1.1. These terms and conditions apply to every offer from Trashious and to every distance agreement concluded between Trashious and the consumer.
1.2. Trashious: Trashious BV, established and with its registered office at Dopheidbeemd 5, 5551 HM, Valkenswaard, Chamber of Commerce number 94746753.
1.3. Consumer: the natural person not acting in the exercise of a profession or business, who orders or purchases a product from Trashious via the website.
1.4. The brand "Trashious" is a protected trademark and registered with the Benelux Office for Intellectual Property (P.O. Box 90404, 2509 LK, The Hague).
1.5. Additions or deviations from these terms must be agreed upon in writing and apply only to the agreement for which they were made.
1.6. The rights and obligations arising from agreements between Trashious and the consumer cannot be transferred by the consumer to third parties, unless with written consent from Trashious.
1.7. Conflicting general terms and conditions will not be accepted by Trashious unless agreed to in writing and confirmed by Trashious.

Article 2. Offers
2.1. All offers are non-binding and valid while supplies last. An offer with a specified period can still be withdrawn by Trashious, even after receipt of the order, provided this is done within 5 working days.
2.2. Quantities, weights, sizes, prices, etc., stated on the website are for informational purposes only. Although the main characteristics of products are displayed as accurately as possible, they are approximate and do not bind Trashious.

Article 3. Agreements

3.1. By placing an order via the website and checking the designated box indicating agreement with the general terms and conditions, the consumer confirms acceptance, and the agreement is established.
3.2. The consumer will receive a confirmation of the agreement via email.

Article 4. Prices

4.1. Prices listed with products are in euros, including VAT and other government-imposed charges.
4.2. Shipping costs charged by Trashious are listed separately on the website.
4.3. Promotional prices are valid only during a specific period and while supplies last.
4.4. Trashious expressly reserves the right to change prices. A price change will only take effect after the consumer has been informed. If a price increase occurs between the order and execution, the consumer has the right to cancel the agreement within ten days of notification.
4.5. Trashious is not bound by prices that are clearly incorrect or contain obvious mistakes.

Article 5. Payment

Payments for website orders can be made using the payment methods listed on the site. When using a third-party credit card or electronic payment method, the terms of the relevant issuer or bank apply.

Article 6. Right of Withdrawal

6.1. Consumers have a 14-day cooling-off period after receiving the product (or third party, such as neighbors), provided the packaging has not been opened. The right expires if the product has been used.
6.2. To exercise the right of withdrawal, the consumer must notify Trashious using the withdrawal form.
6.3. The withdrawal form is available at www.trashious.eu.
6.4. If the consumer exercises the right of withdrawal and returns the unused product with unbroken seal and in original packaging, complete and undamaged, within 14 days, Trashious will refund the payment within 14 days of receiving the return.
6.5. Return shipping costs are the consumer's responsibility.

Article 7. Delivery Time/Shipping

7.1. Trashious aims to ship online orders within 24 hours.
7.2. This delivery term is not binding, and exceeding it does not entitle the consumer to compensation.
7.3. If the product is out of stock, Trashious will attempt to provide a substitute. The substitute product will be clearly communicated upon delivery. Article 6 rights still apply. Trashious covers the return costs for such substitutes.
7.4. Shipping costs are separately listed on the website.
7.5. The consumer must accept and inspect the purchased goods. If delivery is refused or fails, Trashious may store the goods at the consumer's expense and may dissolve the agreement without legal intervention.

Article 8. Execution of the Agreement

8.1. Trashious will execute the agreement to the best of its knowledge and ability.
8.2. Trashious may subcontract tasks without consumer consent.
8.3. The consumer must provide all necessary data in a timely manner. If not, Trashious may suspend execution.
8.4. Trashious commits to professional care, but cannot guarantee consequences of improper use or removal of safety instructions.

Article 9. Warranty/Complaints

9.1. Trashious guarantees that goods are suitable for their intended use and conform to specifications.
9.2. A one-year warranty applies, and three months for repair work.
9.3. Damaged or incorrect products must be reported within 24 hours and may be returned.
9.4. Consumers must read all provided instructions and advice before use.
9.5. Complaints are not accepted if:

• the deviation is within reasonable tolerance,

• items were used improperly,

• damage is due to negligence or ignoring instructions. 9.6. Valid complaints will be addressed by replacement or a price reduction.
  9.7. Complaints do not suspend payment obligations.
  9.8. Voluntary attention to non-compliant complaints does not create rights.

Article 10. Inspection and Risk

10.1. Goods are inspected before delivery.
10.2. Risk transfers to the consumer upon delivery.

Article 11. Non-Performance/Termination/Suspension

11.1. Trashious may terminate or suspend the agreement without legal intervention if:

• the consumer breaches the agreement,

• the consumer dies, seeks suspension of payment, or is declared bankrupt,

• any of the consumer’s assets are seized. 11.2. The above also applies if adequate security is not provided within seven days of request.

Article 12. Retention of Title

Ownership transfers to the consumer only after full payment has been received.

Article 13. Intellectual Property Rights

13.1. All intellectual property rights remain with Trashious.
13.2. The consumer may not reproduce, disclose, or imitate the products without explicit permission.

Article 14. Liability

14.1. Trashious is not liable for damages except as described in the warranty/complaint section, unless due to intent or gross negligence.
14.2. Trashious is not liable for non-supervisory staff or third parties.
14.3. Trashious does not accept liability for advice given.
14.4. Consumers must allow Trashious the opportunity to resolve complaints.
14.5. Liability is limited to replacing the defective product.
14.6. Compensation is limited to the net product price.
14.7. Compensation will never exceed the insured amount if applicable.
14.8. Trashious is not liable for damage, including immaterial or health-related, from improper product use.

Article 15. Force Majeure

15.1. Force majeure includes any situation beyond Trashious’s control, including war, government actions, material shortages, strikes, quarantine, and supplier delays.
15.2. In such cases, Trashious may terminate or suspend the agreement without liability. Payments for performed services remain due.

Article 16. Personal Data

Trashious will process all personal data in accordance with its privacy policy.

Article 17. Partial Nullity
If any provision is invalid, the remaining provisions remain in effect. An appropriate, legally valid alternative will replace the invalid clause.

Article 18. Jurisdiction/Applicable Law

18.1. Trashious’s place of business is the location for fulfilling obligations unless otherwise legally required.
18.2. All offers and agreements are governed exclusively by Dutch law.
18.3. Disputes will be settled by the competent court.
